U.S. Department of Education Releases Guidance to Improve Educational Outcomes of Children and Youth in Foster Care

On June 2, the U.S. Department of Education issued new guidance and resources to help support and emphasize the needs of students in foster care. The guidance provides states with information on how to implement the Uninterrupted Scholars Act (USA), which amends that Family Educational Rights and Privacy Act (FERPA). In addition, the guidance offers details on how the USA amendment will impact confidentiality provisions included in the Individuals with Disabilities Education Act (IDEA). States will receive assistance on improving educational and developmental outcomes for students in foster care, as the guidance ensures authorized agencies have access to students' educational records. In addition, the Department of Education launched the Students in Foster Care website to provide information on laws, guidance, and technical assistance materials.
